Terms of Service
G-Call Service Data Card in Japan

IMPORTANT

Welcome and thank you for choosing G-Call Service Data Card in Japan.
Please read the followings carefully before use.

Article 1 (Scope of TOS)

  1. This Terms of Service ("TOS") shall apply to the G-Call Service Data Card Service ("Service") for users ("User") who have applied and completed all the registration procedure designated by GAP Co. Ltd dba G-Call who runs and operates this Service in Japan ("Provider").

Article 2 (Restriction of Use)

  1. The Service is only available in the coverage area in Japan.
  2. The User shall agree prior to use that Provider shall not be liable for any service interruptions caused by events beyond Provider's control such as weather, geographic condition or technical problem attributable to infra provider.

Article 3 (Order and Contract)

  1. 1. All the terms and condition set forth in this TOS shall become effective when Provider receive and acknowledge application from User. The User'obligation shall start when Provider accepts application and order from User.

Article 4 (Service Period)

  1. The Service period will be counted on a 1 calendar day increments basis and calculated number of days from start of use until the end of use.
  2. The maximum Service period shall not beyond XXX days. Should the applicant desire a term longer than XXX days, please declare so and follow the instruction from Provider.

Article 5 (Application)

  1. If Users is desirous to make reservation to secure the order, User shall apply by at least three (3) days in advance via Fax, web site, or telephone call on or before 12:00 Noon (JST).
  2. *Caution* Please be aware of the time difference of Japan.(GMT+8:00)
  3. In case of a very first time Users, we shall request you to present your passport to verify the User's ID, when Users receive the rental devices ("Equipment").
  4. Despite all the abovementioned provision, User shall agree there may be the case that the service may not be provided due to full booking or other unexpected situation.

Article 6 (Delivery of Equipment)

  1. Equipment can be received at Narita or Kansai Airport or Users' designated places such as hotel, which will be sent by courier prior to start of the Service. If Users want the Equipment to arrive at the designated places more than one day before start of the Service, daily charge shall apply for such additional day.
  2. Provider will thoroughly check the condition of the Equipment prior to delivery and put Equipment in an aluminum case for damage free and safety purpose.
  3. Onetime handling/delivery charge shall cover both way of sending to and returning after use as specified in Article 7-1.
  4. Provider is not responsible for delay or unavailability due to unexpected accident or traffic condition during delivery of Equipment.
  5. Provider is not responsible for unavailability of Equipment at the place to receive solely attributable to Users condition including no show.

Article 7 (Return of Equipment & Delays)

  1. User shall return the Equipment not later than the next day of the service period (Article 4) to the airport counter located in the departure lobby or via courier arranged in advance.
  2. In case of using courier, User shall put the Equipment in the hard case as User originally received it.
  3. If User would like extension of the Service period, User must inform Provider as soon as possible.
  4. Under the case of 3. above, User shall be charged the additional Service fee.
  5. If User does not return all or a part of the Equipment without any notice to Provider, User shall be charged for the delay penalty (2,100yen per day) in addition to regular Service fees until all the part of Equipment is returned.

Article 8 (Charges & Fees)

  1. Service charges shall be 1,050yen /day (incl. tax) and delivery/handling charge shall be 1,050yen /User.
  2. If Provider receives no payment from User in the manner set forth in the Article 9, additional penalty at the rate of 14.5% per annum shall be charged for the unpaid balance until the payment is fully settled.

Article 9 (Billing and Payment)

  1. For existing G-Call customers, Service charges will be combined with other G-Call charges. User acknowledges that Provider accepts only credit card payments from individuals and a first time User.
  2. There might be a case that Provider may bill User all or the portion of Service fee before Service period ends due to billing convenience.
  3. On regular manner, the User shall be charged on its credit card in the next month of the Service period.
  4. There also might be a chase that the bill will be split across more than one time due to the billing procedure.
  5. For pre-arranged User who register other payment method, all the unsettled payment shall be charged on its credit card in case of late or delinquency.
  6. When the penalty for delay or any additional charges apply, Provider will mention the detail in its bill and statement.

Article 10 (Cancellation)

  1. Should User need to cancel the Service before the Service period, User must inform Provider immediately, and cancellation charge of \2,100 shall apply. For cancellations after delivery, User shall also be charged actual cost of delivery in addition.

Article 11 (Verification of Equipment Condition)

  1. User shall check the condition of the Equipment when receive it. It should be reported upon finding any insufficiency or damage to Provider.
  2. If no such declaration is made, User is deemed to have verified and satisfied with the condition and User is liable for any loss/damage of the equipment during the Service period.

Article 12 (Management of Equipment)

  1. User shall use and manage the equipment in good faith in accordance with Provider's manual.
  2. User must immediately report to Provider of loss or damage.
  3. In the event of Item 2 above, unless the fault lies with GAP, User shall be liable for lost or damaged equipment and pay for costs and expenses in recovering the equipment up to a maximum amount of \73,500.

Article 13 (Prohibited Matter)

    The following acts are prohibited:
  1. Acts that may damage performance of the equipment including but not limited to converting, disassembling, or attaching other electrical parts to, the Equipment.
  2. Acts that infringe upon Provider's ownership of the Equipment, including but not limited to subleasing, transferring, or mortgaging of the Equipment.

Article 14 (Indemnity)

  1. User shall acknowledge that Provider is not liable for any loss or damage to User, regardless of the cause, in case of mistakes, misuses or omissions by the User.

Article 15 (Termination)

  1. Provider shall reserve the right to suspend or terminate Service immediately, without prior notice, in case of the following cases happen or found;
    1. Any other Services being rendered by Provider is terminated attributable to User's responsibility.
    2. False in the application stipulated in Article 5.
    3. Denial or negative credibility or credit uncertainty of User.
    4. User breaches any provision of TOS.
  2. Upon termination as mentioned in 1 above, User shall immediately return the Equipment to Provider and compensate for any liability claimed by Provider.

Article 16 (Changes to Terms of Service)

  1. This TOS may be revised or changed without any notice. In such instances, Service conditions shall be determined under the revised TOS.

Article 17 (Jurisdiction)

  1. User shall agree that any conflicts shall be governed under the law of Japan. Any disputes, dissents or claims arising out of, or relating to this TOS and its violation, termination or validity shall be settled in the Tokyo District Court.
